These Terms & Conditions apply to the use of this website and to products and services supplied by E² Energy, operated by Everything Electric Pty Ltd.

By using this website, requesting a quote, placing an order, accepting a proposal, paying a deposit, booking an installation, or proceeding with our products or services, you agree to these Terms & Conditions.

2. Products and services

We may supply energy products and related services, including but not limited to:

    • heat pump hot water systems;

    • solar panel systems;

    • battery storage systems;

    • EV chargers;

    • electrical products;

    • energy efficiency products;

    • installation services;

    • site assessments;

    • product advice;

    • rebate, certificate or incentive support; and

    • related electrical, plumbing or compliance services.

The exact products and services supplied to you will be set out in your quote, order, invoice, proposal, contract, or written confirmation.

3. Quotes and pricing

All prices are in Australian dollars and include GST unless stated otherwise.

A quote is valid for the period stated in the quote. If no period is stated, the quote may be withdrawn or updated at any time before acceptance.

Prices may change due to stock availability, supplier pricing, freight costs, rebate changes, certificate price changes, site requirements, network requirements, compliance requirements, or errors in product information or pricing.

A quote is based on the information available to us at the time. If the information you provide is incomplete, incorrect or changes later, we may need to revise the quote.

4. Orders and acceptance

An order is not accepted by us until we confirm it in writing, issue an invoice, receive payment, allocate stock, or otherwise confirm that we are proceeding.

We may refuse, cancel or delay an order where:

    • stock is unavailable;

    • the product is no longer available;

    • the site is unsuitable;

    • required approvals are not obtained;

    • the advertised price or product information contains an error;

    • rebate, certificate or incentive eligibility is not confirmed;

    • payment has not been received when due;

    • required documents have not been completed;

    • the installation cannot be completed safely or lawfully; or

    • we reasonably consider the order cannot proceed.

5. Rebates, certificates and incentives

Some products or systems advertised on this website may include an estimated rebate, certificate value, government incentive, scheme discount, or upfront discount.

This may include, but is not limited to, STCs, VEU discounts, Solar Homes rebates, battery incentives, solar incentives, hot water incentives, energy efficiency incentives, or other federal, state, territory or scheme-based programs.

Any rebate, certificate value, incentive or discount is subject to eligibility, product approval, site suitability, installation requirements, customer declarations, required documentation, scheme rules, available funding, and final validation by the relevant scheme administrator, accredited provider, certificate aggregator, regulator, government body or other relevant party.

A quoted rebate, certificate value, incentive or discount is not guaranteed until eligibility has been confirmed and all required documents have been completed, accepted and validated.

Where we apply a rebate, certificate value, incentive or discount as an upfront discount, you agree to provide accurate information, sign all required documents, and assign or transfer any relevant certificate, rebate or incentive rights to us or our nominated partner where required.

If false, incomplete, inaccurate or misleading information is provided by you, or if you fail to complete required documents, and this causes the rebate, certificate value, incentive or discount to be rejected, reduced, delayed, cancelled or clawed back, we may require payment of the amount that was originally deducted from the price.

If a rebate, certificate value, incentive or discount changes before installation, we will notify you. You may choose to proceed at the revised price or cancel the order before installation.

6. Site suitability

All products and systems are subject to site suitability.

Site suitability may include, but is not limited to:

    • property access;

    • roof condition;

    • roof orientation;

    • roof pitch;

    • shading;

    • switchboard condition;

    • electrical capacity;

    • metering configuration;

    • plumbing condition;

    • drainage;

    • clearances;

    • wall space;

    • slab or mounting requirements;

    • internet connectivity;

    • product location;

    • noise considerations;

    • safety requirements;

    • network requirements;

    • grid connection requirements;

    • landlord approval;

    • owners corporation approval;

    • building manager approval; and

    • applicable laws, codes and standards.

If we determine that your site is not suitable, we may cancel the order or provide a revised quote for additional work.

If additional work is required to complete the installation safely, legally or compliantly, additional charges may apply.

7. Customer responsibilities

You are responsible for:

    • providing accurate information about the property, existing equipment and your requirements;

    • ensuring you have authority to approve the work;

    • obtaining landlord, owners corporation, building manager or other property approvals where required;

    • ensuring safe and reasonable access to the site;

    • ensuring pets, children and other hazards are kept away from the work area;

    • ensuring someone authorised is available if required;

    • disclosing known defects, hazards, asbestos, unsafe wiring, roof issues, plumbing issues or access restrictions;

    • completing all required forms, declarations and rebate documents truthfully and promptly;

    • making payment when due; and

    • not interfering with, altering or removing installed products unless authorised or required for safety.

We are not responsible for delays, additional costs or failed claims caused by incorrect, incomplete or misleading information provided by you.

8. Installation bookings

Installation dates are scheduled in good faith but are not guaranteed unless expressly stated in writing.

Installation may be delayed due to weather, stock availability, supplier delays, installer availability, access issues, unsafe site conditions, network requirements, inspection delays, third-party approvals, illness, events outside our control, or changes to your order.

We will make reasonable efforts to notify you of delays and reschedule as soon as practicable.

9. Access and safety

You must provide safe, reasonable and timely access to the property.

We may refuse to commence or continue work if we believe the site is unsafe, inaccessible, non-compliant, unsuitable, or materially different from the information provided before the booking.

If we attend site and cannot complete the work due to access issues, unsafe conditions, incorrect information, missing approvals, or other matters outside our control, additional charges may apply.

10. Network, grid and third-party approvals

Some products and systems may require approval, cooperation or action from third parties, including electricity distributors, retailers, metering providers, inspectors, regulators, government bodies, certificate aggregators, accredited providers, landlords, owners corporations, building managers or product manufacturers.

We are not responsible for delays, refusals, additional costs, export limitations, connection limitations, metering issues, inspection delays, or other outcomes caused by third parties.

Where approval is refused or additional work is required, we will discuss your options with you.

11. Product performance and savings estimates

Any savings, payback periods, energy generation estimates, battery performance estimates, hot water performance estimates, rebate estimates or return-on-investment estimates are estimates only.

Actual performance may vary depending on factors outside our control, including weather, household usage, tariff changes, electricity prices, export limits, shading, product settings, maintenance, water usage, system size, network settings, retailer rules and changes to government or scheme requirements.

We do not guarantee any specific financial saving, payback period, export income, energy output, hot water output or battery performance unless expressly stated in writing.

12. Product information

We make reasonable efforts to ensure product information on this website is accurate and current.

However, product specifications, availability, dimensions, warranty terms, eligibility, colours, model numbers, features and prices may change without notice.

Images are for general illustration only and may not show the exact product, model, configuration, installation method or site conditions applicable to your order.

13. Payment

Payment terms will be set out in your quote, invoice, proposal, order confirmation or contract, default terms are 7 days from invoice for all commercial installs otherwise stated.

You must pay all amounts when due.

We may delay delivery, installation, commissioning, documentation, warranty support, certificate processing or handover until required payments have been received.

If payment is overdue, we may recover reasonable costs incurred in collecting the overdue amount, to the extent permitted by law.

14. Cancellations by you

You may request to cancel an order by contacting us in writing.

If you cancel before we have incurred costs, we may provide a full refund of amounts paid.

If you cancel after we have incurred costs, we may deduct reasonable costs already incurred, including supplier charges, delivery fees, restocking fees, assessment costs, design work, booking fees, permit or application costs, administration costs, installation preparation costs and third-party costs.

Once products have been ordered, allocated, delivered, installed, customised, registered, connected or commissioned, cancellation may not be available except where required by law.

15. Cancellations by us

We may cancel or suspend an order where:

    • the product is unavailable;

    • the site is unsuitable;

    • required approvals are not obtained;

    • required documents are not completed;

    • payment is not received;

    • installation cannot be completed safely or legally;

    • rebate or certificate eligibility cannot be confirmed;

    • you provide incorrect, incomplete or misleading information;

    • you breach these Terms & Conditions; or

    • circumstances outside our control prevent us from proceeding.

If we cancel an order, we will refund amounts paid by you, less any reasonable costs already incurred, unless the cancellation is due to our error or failure.

16. Cooling-off rights

A cooling-off period may apply where required by law, including for certain unsolicited consumer agreements such as door-to-door sales or telemarketing.

Where a legal cooling-off right applies, nothing in these Terms & Conditions limits that right.

For ordinary website purchases, quote requests or customer-initiated purchases, there is generally no automatic cooling-off period unless we agree otherwise in writing or one is required by law.

17. Returns and refunds

Returns, refunds, repairs and warranty assessments are handled in accordance with our Refunds & Returns Policy and your rights under Australian Consumer Law.

Our Refunds & Returns Policy forms part of these Terms & Conditions.

18. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.

Nothing in these Terms & Conditions excludes, restricts or modifies any right, guarantee, remedy or protection you have under Australian Consumer Law or any other law that cannot be excluded.

If there is a problem with a product or service supplied by us, you may be entitled to a repair, replacement, refund, cancellation, compensation or another remedy required by law.

19. Manufacturer warranties

Products supplied by us may include manufacturer warranties.

Manufacturer warranties are provided in addition to your rights under Australian Consumer Law and do not replace or limit those rights.

Warranty terms, coverage periods and claim requirements may vary by manufacturer and product.

20. Workmanship

Where we install a product or system, we are responsible for performing the installation with due care and skill and in accordance with applicable legal and compliance requirements.

If you believe there is an installation or workmanship issue, you must notify us as soon as possible and give us a reasonable opportunity to inspect and assess the issue.

21. Unauthorised repairs or modifications

You must not alter, repair, remove, relocate, modify, tamper with or arrange third-party work on a product or system supplied or installed by us without first contacting us, unless urgent action is required for safety reasons.

Unauthorised repairs, modifications or third-party work may affect warranty coverage and our ability to assess a fault or claim.

22. Existing property conditions

We are not responsible for pre-existing defects, non-compliant infrastructure, unsafe wiring, plumbing defects, roof defects, switchboard defects, asbestos, structural issues, drainage issues, meter defects, internet issues, or other existing property conditions unless caused by us.

If pre-existing issues are identified, additional work or third-party services may be required before installation can proceed.

23. Monitoring, apps and internet services

Some products may include monitoring platforms, mobile apps, Wi-Fi connectivity, cloud portals or third-party software.

These services may be provided by the manufacturer or a third party. We do not control third-party platforms and are not responsible for outages, app changes, internet issues, software updates, discontinued platforms, account issues or changes made by third-party providers.

24. Finance and payment providers

If you use a finance provider, payment platform, lender or third-party payment service, separate terms may apply between you and that provider.

We are not responsible for finance approval, declined applications, payment platform delays, lender requirements, fees, charges or decisions made by third-party providers.

25. Website content

The information on this website is general information only.

It does not take into account your specific property, energy usage, financial circumstances, eligibility, network conditions or installation requirements.

You should not rely solely on website information when deciding whether a product or system is suitable for you. Suitability will depend on a quote, site assessment, product selection and applicable requirements.

26. Intellectual property

All website content, branding, logos, text, graphics, images, documents, designs and other materials on this website are owned by or licensed to us unless stated otherwise.

You must not copy, reproduce, modify, distribute or use our content for commercial purposes without our written consent.

27. Photos and installation records

We may take photos, videos, serial number records, compliance records and installation records for quality assurance, warranty, compliance, rebate, certificate, audit, training and record-keeping purposes.

We will handle personal information in accordance with our Privacy Policy.

We will not use identifiable images of you for marketing purposes without your consent.

29. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of savings, loss of opportunity, loss of data, or loss caused by events outside our reasonable control.

Nothing in this clause limits your rights under Australian Consumer Law or any other law that cannot be excluded.

30. Events outside our control

We are not responsible for delay or failure to perform our obligations where caused by events outside our reasonable control, including severe weather, supplier delays, stock shortages, freight delays, installer availability, illness, network delays, regulator delays, inspection delays, government or scheme changes, accidents, safety issues, power outages, system outages, natural disasters, industrial action or other events beyond our reasonable control.

31. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time.

The version published on this website at the time of your order or quote request will apply unless otherwise agreed in writing.

32. Governing law

These Terms & Conditions are governed by the laws of Victoria, Australia.

You agree that any dispute will be dealt with by the courts or tribunals of Victoria, Australia, subject to any rights you have under Australian Consumer Law or other applicable laws.
